This case involved a shooting at the Delta Park Lowe’s parking lot by an armed security guard. A lawsuit was filed by the spouse of the deceased and his estate against the shooter, the security company, Lowe’s, and the property management company, TMT. The case was tried in September 2024 in front of Judge Bagley in Multnomah County. Leading up to the trial, during the trial, and even now after partial entry of judgment, legal issues of interest to defense counsel and OADC continue to arise. Counsel Kirsten Curtis and CJ Martin, both representing defendants in the trial, will discuss those issues, both broadly regarding trying civil cases in Multnomah County, and more directly regarding the ongoing battle with negligence and recklessness in Oregon law.
