Over the last three years, Oregon defense attorneys have struggled to make sense of the Oregon Court of Appeals ruling in Moody v. Oregon Community Credit Union, which seemed to overturn 45 years of Oregon law holding that first-party insurers cannot be liable for non-economic damages. Following the court of appeals ruling, defense attorneys have seen an onslaught of negligence per se claims against carriers with little guidance apart from a growing body of conflicting rulings from the federal bench. It is clear that claims for non-economic damages against first-party insurers are here to stay…at least in some circumstances. Courts have been grappling with the Oregon Supreme Court’s tantalizing statement that “this ruling is a narrow one,” but what has that actually meant in practice?
